{"id":112979,"date":"2022-07-21T07:15:00","date_gmt":"2022-07-21T05:15:00","guid":{"rendered":"https:\/\/renewable-carbon.eu\/news\/?p=112979"},"modified":"2022-07-21T15:07:33","modified_gmt":"2022-07-21T13:07:33","slug":"indigenous-peoples-message-gets-through-in-eu-corridors-of-power","status":"publish","type":"post","link":"https:\/\/renewable-carbon.eu\/news\/indigenous-peoples-message-gets-through-in-eu-corridors-of-power\/","title":{"rendered":"Indigenous Peoples\u2019 message gets through in EU corridors of power"},"content":{"rendered":"\n\n\n<p>By recognising the need for greater protection for Indigenous Peoples and forest defenders, the European Parliament\u2019s environment committee has added a crucial missing jigsaw piece to the draft regulation on deforestation-free products \u2013 now it\u2019s up to member states to follow through, writes Nicole Polsterer.&nbsp;<\/p>\n\n\n\n<p>Since 2019, when Jair Bolsonaro became Brazil\u2019s President, an area of the Amazon larger than&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/fakebook.eco.br\/em-3-anos-multas-caem-39-e-desmatamento-sobe-53\/\" target=\"_blank\">Belgium<\/a>&nbsp;has been destroyed, and the destruction shows no sign of abating.&nbsp;<\/p>\n\n\n\n<p>The link between the Bolsonaro government\u2019s policies \u2013 particularly its&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.fern.org\/publications-insight\/100-days-of-bolsonaro-ending-the-eus-role-in-the-assault-on-the-amazon-945\/\" target=\"_blank\">dismantling<\/a> of environmental protections \u2013 and the ravaging of Brazil\u2019s forests, as well as the rise in attacks against Indigenous Peoples and&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/eur01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Ftheintercept.com%2F2019%2F02%2F16%2Fbrazil-bolsonaro-indigenous-land%2F&amp;data=04%7C01%7Cmark%40fern.org%7Cd8c8b1d00abb41b58d7e08d9924e5bd1%7Ca24cff4fc4864c1ab90df781cd4eee22%7C1%7C0%7C637701688906184117%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000&amp;sdata=cskIaTE1hjKK92CUOLgXy0OmF1oPkBCsdjzphsyEu2c%3D&amp;reserved=0\" target=\"_blank\">armed<\/a>&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/eur01.safelinks.protection.outlook.com\/?url=https%3A%2F%2Freporterbrasil.org.br%2F2019%2F02%2Fsob-ataque-pos-eleicao-terras-indigenas-estao-desprotegidas-com-desmonte-da-funai%2F&amp;data=04%7C01%7Cmark%40fern.org%7Cd8c8b1d00abb41b58d7e08d9924e5bd1%7Ca24cff4fc4864c1ab90df781cd4eee22%7C1%7C0%7C637701688906194074%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C3000&amp;sdata=PINGwdtcdZLKwIg6T9h8Qp7xNRASkKodK2TP0URoLPc%3D&amp;reserved=0\" target=\"_blank\">invasions<\/a>&nbsp;of their land, is clear.&nbsp;&nbsp;<\/p>\n\n\n\n<p>It is also clear that those countries who import goods \u2013 such as soy and beef \u2013 that drive deforestation and human rights abuses in Brazil, must share responsibility for it. As the second biggest market for Brazilian soy and a major importer of Brazilian beef, the European Union ranks near the&nbsp;<a href=\"https:\/\/www.fern.org\/publications-insight\/compelling-new-evidence-shows-the-eus-entanglement-with-illegal-deforestation-for-soy-and-cattle-farming-in-brazil-2188\/\" target=\"_blank\" rel=\"noreferrer noopener\">top<\/a>.<\/p>\n\n\n\n<p>For this reason, the draft Regulation on deforestation-free products, which the European Commission published in November 2021, was a landmark in the fight against deforestation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Under it,&nbsp;six commodities \u2013 coffee, cocoa, cattle, palm oil, soy, wood \u2013 and derived products, will have to undertake due diligence before being placed on the EU market.<\/p>\n\n\n\n<p>Importers and traders will have to establish that the commodities were not produced or grown on land that was deforested or degraded after December 31, 2020 \u2013 and that production hasn\u2019t violated the producing country\u2019s laws.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Serious flaw&nbsp;<\/h3>\n\n\n\n<p>The last point, however, represented a serious flaw in the draft legislation, and one which Fern has been far from alone in&nbsp;<a href=\"https:\/\/www.fern.org\/publications-insight\/eu-to-end-deforestation-protect-land-rights-new-law-should-protect-forest-dependent-communities-2456\/#:~:text=The%20EU's%20draft%20regulation%20on,violations%20as%20defined%20under%20international\" target=\"_blank\" rel=\"noreferrer noopener\">highlighting<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Earlier this year, community leaders of 22 Indigenous organisations from 33 countries \u2013 including those living in the world\u2019s two biggest rainforests, the Amazon and the Congo Basin \u2013&nbsp; wrote an&nbsp;<a href=\"https:\/\/www.fern.org\/publications-insight\/indigenous-organisations-tell-european-policy-makers-to-respect-their-land-rights-or-new-anti-deforestation-legislation-is-likely-to-fail-2461\/\" target=\"_blank\" rel=\"noreferrer noopener\">open letter<\/a>&nbsp;to EU lawmakers, calling for&nbsp;the draft law to be amended so that it includes measures forcing businesses to respect communities\u2019 customary tenure rights, as defined by international human rights standards, rather than national ones.&nbsp;<\/p>\n\n\n\n<p>This message is now resonating in the EU\u2019s corridors of power.&nbsp;<\/p>\n\n\n\n<p>At the end of June,&nbsp;EU Environment Ministers&nbsp;<a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-10284-2022-INIT\/en\/pdf\" target=\"_blank\" rel=\"noreferrer noopener\">adopted<\/a>&nbsp;their opinion on the Regulation. They acknowledged the importance of upholding international human rights standards, adding references to the United Nations Declaration on the Rights of Indigenous Peoples, and other key international texts, and calling on companies to give greater consideration to international human rights standards.&nbsp;&nbsp;<\/p>\n\n\n\n<p>This week, the European Parliament\u2019s ENVI Committee also&nbsp;<a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20220711IPR35009\/climate-change-new-rules-for-companies-to-stop-eu-driven-deforestation-globally\" target=\"_blank\" rel=\"noreferrer noopener\">listened<\/a>&nbsp;to the growing chorus of voices calling for Indigenous Peoples and forest defenders to be given greater protection in the Regulation: voting for a proposal which would mean that companies placing products on the EU market would have to respect international standards on customary tenure rights, as well as the right to free, prior and informed consent (FPIC).&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Missing jigsaw piece<\/h3>\n\n\n\n<p>Brazil offers an unambiguous example showing why this is the crucial missing jigsaw piece in this Regulation.&nbsp;<\/p>\n\n\n\n<p>As our partner, S\u00f4nia Guajajara of the&nbsp;<a rel=\"noreferrer noopener\" href=\"http:\/\/apib.info\/apib\/?lang=en\" target=\"_blank\">Articula\u00e7\u00e3o dos Povos Ind\u00edgenas do Brasil\u202f<\/a>(Articulation of Indigenous People of Brazil) (APIB), has&nbsp;<a rel=\"noreferrer noopener\" href=\"https:\/\/www.climatechangenews.com\/2021\/10\/19\/uk-eu-must-not-abet-theft-indigenous-territory-brazil\/\" target=\"_blank\">pointed<\/a>&nbsp;out: \u201cLeaving\u202fthe protection of&nbsp;Indigenous rights\u202fin Bolsonaro\u2019s hands is like leaving a fox in charge of a chicken coop<em>.<\/em>\u201d&nbsp;&nbsp;<\/p>\n\n\n\n<p>The EU and its citizens must not be complicit in this.&nbsp;<\/p>\n\n\n\n<p>The onus is now on the European Parliament\u2019s plenary, who will vote in September, to follow the positive lead set by the ENVI Committee, and ensure that the Regulation includes specific&nbsp;measures requiring businesses to follow international laws and standards.
